1. Definitions

• "We", "us", "our" refers to Illusion Tricking, including its owners, staff, contractors, and agents.
• "You" or "Participant" refers to any individual (or their parent/guardian if under 18) who enrols in or attends our classes, events, or uses our facilities.

2. Your Consumer Rights

Nothing in these terms limits or excludes any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand law that cannot be excluded by agreement. If any part of these terms conflicts with those rights, your rights under the law apply instead.

3. Risk and Injury

Tricking, tumbling, parkour, and related movement activities involve physical risk, including the risk of injury. We take reasonable steps to keep our classes and facilities safe, and by participating you acknowledge that some risk remains even when everyone takes care.

Personal injury from an accident in New Zealand is generally covered by ACC (the Accident Compensation Corporation). We will help you lodge an ACC claim if you are injured at one of our classes or events.

We remain responsible for meeting our duties under the Health and Safety at Work Act 2015, and nothing in these terms changes those duties.

4. Medical Information

You agree to tell us before class about any injury, health condition, or medication that may affect your (or your child's) safe participation, and to let us know if anything changes. If you are unsure whether an activity is suitable, please check with a health professional first.

In an emergency, you authorise us to seek medical assistance on your (or your child's) behalf. Any medical costs not covered by ACC or another funder are your responsibility.

5. Supervision of Minors

Participants under 18 must have the consent of a parent or legal guardian. Children under 5 must be accompanied by a responsible adult while on the premises, unless otherwise agreed.

6. Class Rules and Code of Conduct

To keep everyone safe and respected, you agree to:

• Follow all instructions given by instructors or staff.
• Wear appropriate clothing and remove jewellery before class.
• Treat others with respect and refrain from disruptive or dangerous behaviour.

If someone's behaviour puts others at risk, we may ask them to leave the session. For serious or repeated breaches, we may cancel their enrolment. We will consider any refund or credit fairly, taking into account the circumstances and any sessions already attended.

7. Payment and Cancellations

• Class fees must be paid on or before the first class, by bank transfer, by card online, or in person at the session.
• Paying online by card adds a card processing fee to cover our payment provider's charges. The fee is shown before you pay. Other payment methods have no fee.
• Term bookings are generally non-refundable once the term has started. This does not affect your rights under the Consumer Guarantees Act 1993, for example if a service is not provided with reasonable care and skill.
• If you miss classes due to illness or injury and let us know, we may offer a credit or make-up session.
• We may cancel or reschedule classes due to low enrolment, staff availability, or events outside our control. If we cancel a class and cannot offer a reasonable replacement, we will give you a refund or credit for that class.

8. Photos and Video

We sometimes take photos or video at classes and events to use on our website, social media, and marketing. If you do not want you (or your child) to appear in these, let us know at enrolment or email us at illusion.tricking@gmail.com and we will respect that. You can withdraw your consent at any time and we will remove existing images where reasonably practicable.

9. Privacy

We collect and handle personal information in line with the Privacy Act 2020.

• What we collect: names, contact details, ages, emergency contacts, and health information you provide at enrolment.
• Website accounts: to book online you create an account with your email address and a password, or by signing in with Google. If you use Google, we receive your name and email address from Google, and nothing else. Your account stores your contact and emergency details and, for each person you book for, their name, date of birth, any medical information you give us, and their photo consent. Each booking keeps a copy of these details so we have them on the day.
• Why: to manage enrolments and payments, keep participants safe, and contact you about classes and events.
• Who we collect it from: usually directly from you. If you enrol someone else (such as your child), please make sure they or their guardian know you have given us their information and have seen this notice.
• Where it is stored: securely, including with online service providers we use to run our business. Website accounts and bookings are stored with Google Firebase, which also handles signing in, and we use email to send booking confirmations. These providers may store information outside New Zealand. Only we can see your booking details; your password is handled by Firebase and we never see it.
• Sharing: we do not share your personal information with anyone else without your consent, unless required or permitted by law (for example, with emergency services).
• Your rights: you can see and update your saved details at any time on the My Account page. You can also ask to see or correct the personal information we hold about you, or ask us to delete your account, by emailing illusion.tricking@gmail.com. If you are not happy with how we have handled your information, you can complain to the Office of the Privacy Commissioner (privacy.org.nz).

10. Our Liability

Subject to section 2 (Your Consumer Rights) and to the extent permitted by law:

• We are not liable for loss of or damage to personal belongings brought to classes, unless caused by our negligence.
• We are not liable for indirect or consequential loss arising from your participation.

You are responsible for any damage to our equipment or premises caused deliberately or carelessly by you (or your child).

11. Changes to Terms

We may update these Terms and Conditions from time to time. The current version will always be posted on our website with its effective date. We will let enrolled participants know about any significant changes before they take effect. Changes will not apply to a term you have already paid for unless you agree to them.

Parent/Guardian Agreement (for participants under 18)

I am the parent or legal guardian of the participant. I have read and understood these Terms and Conditions and give permission for my child to participate in classes at Illusion Tricking. I understand the physical nature of the activities and agree to these terms on my child's behalf.

Birthday Party Terms and Conditions

By booking a birthday party at Illusion Tricking, you ("the Client", "you", or "the Hirer") agree to the following Terms and Conditions, in addition to the general terms above.

1. Booking & Arrival

• Bookings must be confirmed in writing and secured with a $50 deposit. The deposit is non-refundable if you cancel, except where required by law or where we cancel and cannot offer a suitable new date.
• Party organisers may arrive no earlier than 15 minutes before the scheduled start time to set up.
• All attendees must leave the premises within 15 minutes after the scheduled end time. Additional charges may apply for late departure; we will tell you the rate when you book.

2. Rubbish and Cleaning

• You are responsible for removing all rubbish and decorations at the end of your party, including food waste, packaging, balloons, and streamers.
• A reasonable cleaning fee may be charged if excessive rubbish or mess is left behind.

3. Food and Equipment Use

• No food or drink is permitted on or near any training equipment at any time.
• All food and drink must be consumed in designated areas only.
• If this rule is repeatedly ignored after a warning, we may end the party early.

4. Health and Safety

• All guests must follow the instructions of Illusion Tricking staff at all times.
• Children must be supervised by an adult at all times.
• Activities on trampolines, parkour equipment, and tricking elements are physical and carry some risk of injury, as described in section 3 of the general terms above.

5. Damage

You are responsible for any damage to our equipment or premises caused deliberately or carelessly by you or your guests. Our liability is as set out in section 10 of the general terms above, and nothing in these birthday party terms limits your rights under New Zealand consumer law.

6. Conduct

• We may refuse entry to, or remove, any person whose behaviour is unsafe, disruptive, or inappropriate.
• No alcohol, illegal substances, smoking, or vaping is permitted on the premises.

7. Cancellations

• If we need to cancel or reschedule your booking due to unforeseen circumstances (for example maintenance, weather, or emergencies), we will offer you a new date. If no suitable date can be found, we will refund all amounts you have paid, including your deposit.

8. Acceptance

By proceeding with a booking, you confirm that you have read, understood, and agree to these Terms and Conditions.
